Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and OnlineBuilders LLC ("Company," "we," "us," or "our"), a limited liability company registered in the State of Delaware, USA, governing your access to and use of the SocialChecker application and website (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms in their entirety. If you do not agree, you must not use the Service.

2. Description of Service

SocialChecker provides social media monitoring tools, including profile tracking, following/follower change detection, story archiving, and related analytics features. The scope and availability of features depend on the subscription plan selected by the User.

3. Eligibility

You must be at least 16 years of age (or the applicable age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.

5. Subscriptions & Payments

The Service offers the following subscription plans:

• Basic — $4.99/month
• Premium — $9.99/month
• Ultra — $24.99/month

Subscriptions are billed in advance on a monthly recurring basis. Payment is processed through third-party payment providers (Apple In-App Purchase, Stripe). All fees are non-refundable except as required by applicable law or as otherwise stated herein.

We reserve the right to modify pricing at any time. Price changes will take effect at the beginning of the next billing cycle following notice to you.

6. Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have already paid.

For subscriptions purchased through Apple App Store or Google Play, cancellation and refund policies of the respective platform apply.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Harass, stalk, threaten, or harm any person
• Collect data for unlawful purposes or in violation of any platform's terms of service
• Distribute malware, spam, or other harmful content
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Circumvent any security measures or access restrictions
• Use the Service for any commercial purpose not authorized by us
• Resell, sublicense, or redistribute the Service or its data

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and design — are owned by OnlineBuilders LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9. User Content & Data

You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of operating and improving the Service. Upon termination of your account, your data will be deleted within 30 days, unless retention is required by law.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA PROVIDED THROUGH THE SERVICE IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONLINEBUILDERS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless OnlineBuilders LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 8, 10, 11, 12, 14, and 15 shall survive termination.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, USA. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against OnlineBuilders LLC.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
